Court Approves Landmark Settlement Requiring Prison System to Expand Hepatitis C Testing and Treatment

Civil rights groups and the state have two weeks to come up with a plan to test every person incarcerated in North Carolina.

In 2020, the North Carolina Supreme Court ruled that the state's 2013 legislative repeal of the 2009 Racial Justice Act (RJA) could not be applied retroactively to death row inmates who had already filed claims, restoring rights for approximately 140 prisoners to challenge their sentences due to racial bias. The court found that applying the repeal retroactively violated state and federal constitutions.

NCPLS and the ACLU of North Carolina have filed a class action lawsuit alleging that the state's use of solitary confinement inflicts "cruel or unusual punishment" prohibited by the North Carolina Constitution.
