Grievances and the Administrative Remedy Procedure
The North Carolina Department of Adult Correction created an administrative remedy procedure, which people in prison can use to report problems, and for staff members to respond to those issues, before people file lawsuits. This procedure is more commonly known as the grievance process. However, we get letters every week from people who are having issues using the grievance process, including having trouble getting the grievance (DC-410) forms, staff interfering with people who are trying to file those forms, and fear of retaliation for filing grievances. By law, before a person in prison can file a lawsuit about something that happened to them in prison, they have to follow each step in the grievance process from the beginning through the final (“Step 3”) appeal. This letter explains more about the grievance process, and includes suggestions for how to resolve some of the most common problems people encounter when trying to use the grievance process.
